The retail sale or soliciting of orders for commercial products or services by the vendor from a stationary location, with or without a temporary structure, is prohibited on any street, street right-of-way or other public property, or upon any private property except in compliance with applicable zoning and land use regulations.(b)The provisions of this article shall not apply to, and it shall be a defense, if the activity is:(1)On-premise outside retail or promotional sales;(2)Approved sales at city sponsored events;(3)Fund-raising efforts of primary and secondary school students for school programs or events; or(4)Sales conducted by a section 501(c)(3), Internal Revenue Code, non-profit organization.
