Amplified music rules in Rowlett, TX โ also called sound permit, PA system, or live music ordinances โ set decibel limits, time-of-day restrictions, and when permits are required.
Rowlett's Sec. 22-205(2) prohibits operating any radio, musical instrument, television, phonograph, drum, or other sound-reproducing device so as to violate the Sec. 22-204 sound limits or unreasonably disturb neighbors. Sec. 22-205(3) covers loudspeakers and sound-amplifying equipment in streets, parks, and public places.
Amplified and reproduced music is regulated as a specific prohibited noise in Rowlett's Code of Ordinances. Under Sec. 22-205(2), it is unlawful to operate or permit to be operated any radio receiving set, musical instrument, television, phonograph, drum, or other machine or device for the production or reproduction of sound in a manner that either violates the measured sound levels in Sec. 22-204 or 'unreasonably disturbs or interferes with the peace, comfort, and repose of neighboring persons of ordinary sensibilities.' Sec. 22-205(3) separately bars operating any loudspeaker or sound-amplifying equipment, fixed or movable, mounted on any street, alley, sidewalk, park, place, or public property under the same standard. The applicable Sec. 22-204 limits depend on the receiving district: 65 dBA (L10) daytime and 60 dBA at night in residential zones, with companion L90 limits of 55 and 50 dBA. Because the rule includes an 'unreasonably disturbs' test, amplified music can be a violation even when a meter reading is not taken. Occasional permitted outdoor events, public dances, parades, and entertainment events conducted under a city permit or license are exempt under Sec. 22-206(8). The Department of Planning and Environmental Services has primary enforcement responsibility (Sec. 22-207).
Playing amplified music in violation of Sec. 22-205(2) or (3) is a Chapter 22 violation, punishable under Sec. 1-13 by a fine not exceeding $500.00 where no other penalty is fixed, with each day a separate offense. Permitted special events under Sec. 22-206(8) are exempt. The city may also pursue nuisance abatement against repeat offenders.
