The Sec. 22-206 exemptions are time-limited: home repair of a residence (subsection 11), repair of a personal-use vehicle (10), and use of lawn maintenance equipment (9) are exempt from the Sec. 22-204 limits only between 7:00 a.m. (9:00 a.m. on Sundays) and 10:00 p.m. Outside those hours, and for commercial construction generally, the decibel and nuisance limits apply. Emergency and public-service work (Sec. 22-206(2)) is exempt. A variance from the article's requirements may be granted by the director under Sec. 22-208. Enforcement rests with the Department of Planning and Environmental Services (Sec. 22-207).
Construction noise that exceeds the Sec. 22-204 industrial limit or unreasonably disturbs neighbors is a violation of Chapter 22, punishable under Sec. 1-13 by a fine not exceeding $500.00 where no other penalty is fixed, with each day a separate offense. The city may also seek abatement or injunctive relief. A variance for time of compliance may be requested under Sec. 22-208.
