Dallas Code Section 30-2 restricts construction near residential use to 7 AM-7 PM weekdays and 8 AM-7 PM on Saturdays and legal holidays. Construction outside these hours is automatically presumed offensive.
Section 30-2 of the Dallas Code of Ordinances regulates construction noise adjacent to residential use. Construction activity related to erection, excavation, demolition, alteration, or repair of any building on or adjacent to a residential use is prohibited outside the hours of 7:00 AM to 7:00 PM Monday through Friday and 8:00 AM to 7:00 PM on Saturdays and legal holidays. Legal holidays include New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas. Construction outside these windows is automatically presumed offensive. The Director of Transportation and Public Works may issue a written permit for after-hours work only in cases of urgent necessity in the interest of public safety or for reasons determined necessary for public health, safety, or welfare.
Construction outside permitted hours is automatically a violation of Section 30-2. Offenses under Chapter 30 are punishable by a fine of up to $2,000. Civil penalties up to $1,000 may also apply. Stop-work orders may be issued for repeated violations.
