Brookhaven, NY Food Trucks & Mobile Vendors: Vending Zones (2026)

Chapter 10 of the Brookhaven Town Code, the Town Park Local Law, governs conduct inside all parks, playgrounds, athletic fields, beaches, boardwalks, marinas and recreation areas the Town owns or controls. Section 10-21, "Selling, peddling and soliciting," splits the rule in two parts. Subsection A bars anyone from selling, offering for sale, hiring, leasing or letting out any object, merchandise or service in a park without first obtaining a permit. Subsection B goes further: even with a permit in hand, sales are confined to areas the Town Board, the Trustees of the Freeholders and Commonalty, or their authorized representatives have specifically designated for vending.

That means a food truck or cart cannot park at the edge of a ballfield or a boardwalk entrance just because it obtained a general vendor permit; it has to operate inside a Town-designated vending location within that specific park. Chapter 10's definitions section, § 10-2, makes clear "park" sweeps in beaches, pools, marinas and boardwalks in addition to traditional parkland, so the designated-area rule follows the vendor to any Town recreation property, not just neighborhood parks. Enforcement runs through the Commissioner of Parks, Recreation and Sports and Cultural Resources and Town-designated park officials, who can eject a vendor operating outside a designated zone or without the required permit.
