Brookhaven, NY Parking Rules: Commercial & Oversized Vehicles (2026)

Section 85-855, 'Prohibited uses,' of the Town's zoning chapter singles out commercial trucks for residential neighborhoods. Subsection B(1) states flatly that the parking of commercial vehicles with a gross vehicle weight rating of 10,000 pounds or more on residential streets and residential property is prohibited. The same subsection carves out three exceptions in B(2): vehicles at or under the 10,000-pound GVWR threshold, commercial vehicles actively making local deliveries, and commercial vehicles owned by public utilities or government and municipal agencies when needed for maintenance, repair or construction of public utility or municipal services and facilities.

The rule sits in the same article as Brookhaven's front-yard parking ban in § 85-855A, which separately bars parking in a required front yard other than in a driveway and bars using any parking or loading area for sales, storage of trailers, carts, boats or car parts, or for repair, dismantling or servicing work. Because § 85-855 is specifically named in § 85-158E's enhanced penalty schedule, a residential-street truck-parking violation is treated more seriously than an ordinary zoning infraction, with escalating fines for repeat offenses within a five-year window and eventual misdemeanor exposure.

Enforcement runs through the Chief Building Inspector's office, and a property owner who continues to violate can also face revocation of a certificate of occupancy under § 85-857 if required parking or loading facilities are not being maintained in compliance.
