An operator who needs to load or unload during the restricted window can apply to the Noise Control Administrator for relief; § 50-8 lets any noise source apply for a variance by describing the facility, the reason for the request, the expected noise intensity and interim control measures, and the Administrator can charge a fee set by Town Board resolution. A variance under § 50-8D cannot run longer than 15 days at a time, and no applicant can hold more than 30 days of variances in a calendar year, though it can be extended by a new application and acts as a stay of prosecution while active.
