Full Breakdown
York County, Virginia zones mobile food vending to specific locations under Code § 24.1-453(c) and (d). A food truck can only set up in the commercial and industrial districts already listed in the § 24.1-306 table of land uses, and additionally in the commercial areas of any approved and developed planned development mixed-use district (PD-MU); vending in a residential district or on undeveloped land is not permitted at all under this section. Within an eligible district, the truck must operate only on developed and occupied property, and only while the on-site business or industrial establishment it is paired with is open; it cannot show up on a vacant lot or after the host closes for the day.
The operator needs written consent from the property owner before parking there. Trucks must stay at least one hundred feet from any residential dwelling, and unless otherwise approved, they must leave the site entirely when the host establishment closes, picking up all trash within twenty-five feet of the vehicle before leaving. Vending vehicles can never be parked in or operated from a public street right-of-way, and they cannot block pedestrian or bicycle access, obstruct traffic or parking-lot circulation, or take up required parking spaces in an existing lot. A food truck park approved under § 24.1-474.1 still has to keep each vendor's location inside these same district and site limits.
Violations & Fines
A truck parked in a residential district, on undeveloped land, on a public street right-of-way, or operating outside the host business's hours violates § 24.1-453 and can trigger permit revocation by the Zoning Administrator after a written notice of violation. Operators who fail to correct the noncompliance within the notice deadline lose the permit and can appeal only to the Board of Zoning Appeals.
