Las Cruces limits yard, garage, rummage, tag, or moving sales to no more than three times per calendar year at any one location. Running sales beyond that turns a residence into an unpermitted retail operation and draws Codes Enforcement action.
The frequency cap is set by the City's zoning rules in the Land Development Code (Chapter 38): no more than three yard, garage, rummage, tag, or moving sales per calendar year at any single location. The limit exists to keep residential lots from operating as de facto stores. Holding sales more often, or leaving merchandise out for continuous sale, crosses from a permitted accessory use into an unpermitted commercial use of a home and is enforced separately by Codes Enforcement at 575-528-4100. The three-sale cap is per location, so it follows the address, not the individual seller. Each permitted sale may run no more than four consecutive days.
Exceeding three sales per calendar year at one location, or running continuous sales that amount to a home business, violates the zoning code. Codes Enforcement can cite it as a petty misdemeanor: up to $500 or 90 days in jail.
