City of Las Cruces design standards chapter 32 separate three wall categories by how much soil they hold back. A garden wall retaining 24 inches of grade differential or less can be built from the manufacturer's specifications with no engineer and no building permit. Go over 24 inches and the structure is legally a retaining wall, triggering city review for adequacy, zoning, and ordinance compliance before any construction permit issues. A private yard wall that does not retain grade can rise to 8 feet without an engineered design, but still needs a wall and fence zoning certificate if it is 6 feet or under, or a full building permit and inspection above that height.

Every true retaining wall, regardless of type, mechanically stabilized earth, gabion, reinforced concrete, reinforced earth, bin, anchored, rock gravity, or terraced, must be designed by a New Mexico-registered engineer. 5 against overturning, sliding, and foundation bearing failure, and drainage systems sized to keep hydrostatic pressure off the wall face. Walls over 8 feet high need two staggered rows of weep drains. Walls bordering public rights-of-way, holding back more than 2 feet of soil, or carrying a surcharge within one wall-height of the fill side must be built to their full ultimate height in the first construction phase, not phased in later.

In-ground pools and ponds must sit back the larger of 10 feet or twice the retaining wall height from the wall. Any retaining wall in or adjacent to a special flood hazard area must also be engineered for flood saturation and erosion, tying the wall design back to the city's chapter 34 floodplain rules. The engineer of record must certify, after site visits, that construction matches the permitted plans.
