Unlike many cities, Las Cruces requires an approved building permit for every fence, wall, and retaining wall. Simple residential fences can use a fast over-the-counter permit that waives plan review.
Design Standards Section 32-136 requires a building permit for all fence, wall, and retaining-wall construction inside the city, with no blanket height exemption. The Community Development Department offers an over-the-counter permit for straightforward residential fences, where the applicant waives detailed plan review to speed issuance but still must meet zoning, building-code, and design standards, verified at field inspection. Permits do not authorize violating setbacks, easements, or clear-sight requirements. Ordinance No. 949 established the rule; Ordinance No. 2131 amended it.
Building a fence without the required permit is a code violation subject to stop-work orders, after-the-fact permitting, and correction of any noncompliant work at the owner's cost.
