Under FL ยง720.3035, HOA architectural review authority must be based on powers granted in the recorded declaration of covenants. The ARC must apply objective standards consistently, provide written reasons for denial, and cannot arbitrarily deny applications. Common ARC review items: exterior paint color, roofing materials, fence style and height, driveway modifications, solar panels (see FL ยง163.04 preemption), sheds, pools, landscaping changes, and flag displays. Homeowners must submit applications per the HOA process before starting work, typically with drawings, material specifications, and contractor information.
Unapproved modifications: HOA can seek injunctive relief, forced removal, fines (if declaration authorizes), and recovery of attorney fees. FL ยง720.305 limits fines to 100 dollars per violation/day up to 1,000 dollars aggregate unless declaration provides otherwise.
