Converse HOA ARCs follow recorded CCRs and Property Code Ch 209. They cannot ban solar (202.010), standby generators, xeriscaping, or rainwater harvesting (202.007). Written design guidelines must be provided to owners.
Most Converse subdivisions developed in recent decades are governed by recorded CCRs that empower an architectural review committee to approve changes to the exterior appearance of lots and homes. Texas Property Code 209.00505 requires that ARC decisions be based on written guidelines adopted by the board and made available to all owners. Members of the ARC cannot be the same persons who sit on the appeals panel. Owners denied approval must be given written reasons and a reasonable opportunity to appeal. Texas law places substantive limits on what ARCs can prohibit. Property Code 202.010 bars HOAs from prohibiting solar energy devices that substantially comply with the statute setbacks. Section 202.007 protects composting, rainwater harvesting systems, drought-resistant landscaping, and flag displays. Section 202.011 protects display of religious items on door frames. Section 202.019 protects standby electric generators. Section 202.018 limits restrictions on certain firearms training signage. ARC approval still applies to fences, roofs, paint colors, additions, decks, patios, pools, landscaping plans, play structures, and driveway expansions. A typical ARC turnaround under CCRs is 30 to 45 days; if the ARC fails to respond within the stated time, many CCRs deem the request approved.
Unauthorized exterior modifications can result in HOA enforcement including fines up to $200 per violation under Property Code 209.006, required removal of the improvement, and recorded liens. If the owner prevails showing the HOA violated statutory protections, attorney fees may be recoverable under Property Code 209.008.
