Mission Viejo was developed as a master-planned community by the Mission Viejo Company beginning in the 1960s, and virtually all residential properties are subject to CC&Rs enforced by homeowners associations. The architectural review process is a central feature of HOA governance in Mission Viejo. Homeowners must submit an architectural application to their community's Architectural Review Committee (ARC) or equivalent body before undertaking exterior modifications including but not limited to: exterior painting and color changes, roof replacement, window and door replacements, landscaping changes visible from the street, fence and wall construction or modification, patio covers and shade structures, solar panel installations, room additions, garage door replacements, and driveway modifications. Applications typically require a detailed description of the proposed work, material samples, color chips, drawings or plans, and a site map showing the location of the modification. The ARC reviews applications against the community's architectural guidelines and design standards. Review periods vary by HOA but generally range from 15 to 45 days. California Civil Code Section 4765 requires HOAs to approve or deny applications within 60 days of receipt, after which the application is deemed approved. HOAs cannot unreasonably restrict solar panel installations under the California Solar Rights Act (Civil Code Section 714) or satellite dish installations under FCC regulations.
Homeowners who proceed with modifications without ARC approval may receive a violation notice requiring restoration of the original condition at the homeowner's expense. Fines for unapproved modifications vary by HOA but typically range from $50 to $200 per violation with escalation for continued non-compliance. HOAs may also pursue legal action to compel removal of unauthorized modifications.
