Election disputes and recall disputes under FL ยง720.306(9) go to binding arbitration through the DBPR Division of Florida Condominiums, Timeshares, and Mobile Homes. Prevailing party in litigation entitled to attorney fees under FL ยง720.305(1). Plant City HOAs cannot require waiver of these rights in governing documents.
Bypassing required mediation: lawsuit dismissed with attorney fees to responding party. Refusing to mediate in good faith: court may award fees.
