Nevada Revised Statutes 446.866 establishes the state cottage food operator framework and prevents local governments from prohibiting cottage food operations. Residents of North Las Vegas may produce non-potentially hazardous foods (baked goods, jams, jellies, candies, dried herbs, granola, and similar shelf-stable items) in their home kitchen and sell directly to consumers at farmers markets, swap meets, church bazaars, garage sales, craft fairs, and by in-person transactions on the private property of the producer. Sales via telephone, internet, or to retail stores and restaurants are not allowed under state law. Annual gross revenue may not exceed 35,000 dollars, and products must be labeled as home-prepared. Cottage food operators must register with the Southern Nevada Health District (SNHD), which has inspection authority only when investigating complaints of adulteration or foodborne illness. A City of North Las Vegas business license under Title 5 is generally required for the commercial activity in addition to SNHD registration. As of July 1, 2025, Nevada Department of Agriculture assumed state food regulatory authority under SB 466 (2025).
