Nevada Revised Statutes Chapter 446 (as amended) and Southern Nevada Health District (SNHD) regulations authorize Cottage Food Operations (CFOs) to produce specific low-risk shelf-stable foods in a home kitchen for direct sale to end consumers. Permitted items include baked goods without cream or meat fillings, jams and jellies, dry mixes, granola, dry herbs, candies, and similar non-potentially-hazardous foods. Excluded are any foods requiring refrigeration, meat and poultry products, acidified canned goods, and any beverages beyond specified items. Sales are limited to direct in-person transactions at the operators home, at farmers markets, at community events, and similar face-to-face venues; wholesale sales to stores or restaurants and shipping of food to customers are prohibited. Annual gross sales are capped at $35,000. Operators must register with SNHD and follow labeling requirements stating the food is made in a home kitchen not subject to regular inspection. Henderson also requires a city business license under HMC Title 4 and the home occupation to comply with Title 19 standards.
Selling non-authorized foods or exceeding the sales cap can trigger SNHD enforcement and require full commercial kitchen licensing. Henderson will cite unlicensed home businesses under HMC Title 4.
