Arizona's cottage food law (ARS 36-1561) allows Surprise residents to sell homemade food products from their homes without a food handler's permit. Annual sales are capped at $75,000. Allowed products include baked goods, candies, jams, and other shelf-stable items.
Arizona's cottage food law (ARS 36-1561) is among the most permissive in the nation. Surprise residents may produce and sell approved cottage food products from their home kitchen without a food establishment license or food handler's certification. The annual gross sales cap is $75,000. Approved products include baked goods, candies, jams, jellies, fruit butter, granola, dry mixes, popcorn, and other non-potentially-hazardous foods that do not require refrigeration. Products must be labeled with the producer's name and address, a statement that the product was produced in a home kitchen not inspected by the health department, and common allergen information. Sales may be direct (farmers markets, online, door-to-door) but not through retail stores. A TPT license from Arizona DOR is required for tax collection purposes.
Selling unapproved foods (those requiring refrigeration) or exceeding the $75,000 cap violates ARS 36-1561. Missing labeling requirements may result in enforcement. Tax collection violations are handled by Arizona DOR.
