Ohio Revised Code Chapter 5104 governs family child care homes. A 'Type B family child care home' is the provider's permanent residence caring for one to seven children at one time, with no more than three under age two. A 'Type A family child care home' is the administrator's residence caring for a larger group (up to fourteen children, with additional limits when several are under two). Licenses are issued by the state (historically ODJFS, now administered through the Ohio Department of Children and Youth) under section 5104.03. Summit County does not license home daycares. Separately, your city or township zoning may regulate home daycare as a home occupation, so confirm local zoning too.
Operating a Type A or licensed Type B home without a valid state license under ORC 5104.03 is prohibited and subject to state enforcement, including cease-operation orders and penalties. Zoning violations are enforced locally.
