Section 1002.A.12 of the County Zoning Ordinance permits a small home day care as accessory to any dwelling, provided it meets the general home-occupation standards plus two extra conditions: any outdoor play area must sit in the side or rear yard (not adjacent to a street) and be enclosed by a solid, opaque fence; and no more than eight children unrelated to the operator may be cared for during any 24-hour period. Beyond zoning, North Carolina requires a state child-care license from the Division of Child Development and Early Education (NCDHHS) for a family child-care home serving three or more unrelated children.
Exceeding eight children, lacking the required play-area fencing, or operating without the state child-care license can trigger county zoning penalties and NCDHHS enforcement.
