Home child care is regulated statewide by the Utah Department of Health and Human Services, Division of Licensing and Background Checks, under Utah Child Care Licensing rules (Utah Admin Code R430; Utah Code Title 26B). A provider of five to eight qualifying children must obtain a Residential Child Care Certificate from the department. Providers caring for fewer children may be exempt but still submit background checks; limits reference up to eight qualifying children (or up to ten including the provider's own). On top of the state certificate, a home daycare must still comply with local zoning as a home occupation and hold a city or county business license.
Operating a home child care above the exempt count without the required state certificate or license is a violation subject to Utah DHHS enforcement, and may also breach city/county zoning rules.
