A licensed home day care is one of the five categories of permitted home occupation the zoning ordinance recognizes at Sec. 24-5-207(3). Subsection (e) is the only one with a flat numeric ceiling instead of a traffic-based test: no more than nine children may be on the premises at any time, regardless of ages or how many are the provider's own. That cap applies to total attendance, not just enrollment, so drop-in or overlapping pickup times count toward the nine.

Because a day care is a home occupation, it also has to satisfy the general use limitations of Sec. 24-5-207(4): the business must be conducted entirely inside the enclosed principal structure and can't be visible from any residential structure or public way, it cannot occupy more than ten per cent of the dwelling's floor area, there can be no outdoor storage of equipment or materials, and no employee is permitted other than a resident of the dwelling, meaning a provider cannot hire outside staff to help supervise the children. Signage is limited to a single non-illuminated name plate no larger than two square feet if mounted on the house. No home occupation, day care included, may generate noise, odor, glare, or other nuisance outside the residence, and only one vehicle connected to the business may be kept on site.

A day care that exceeds nine children, hires a non-resident employee, or operates outside the enclosed structure loses its status as a permitted home occupation and is enforced as a zoning violation under Sec. 24-6-102, a misdemeanor punishable by a fine of $10 to $250 or up to 30 days in jail per day, or an administrative civil fine of up to $500 per offense.
