All family child care homes must be licensed by the California Department of Social Services, Community Care Licensing Division (Title 22). Under state law (SB 234), cities may not impose business license fees or special use permits on small or large family child care homes beyond what state law allows.
Operating a large family child care home in violation of the 300-foot spacing (without a CUP) or the 6:30 a.m.-7:30 p.m. hours, or operating any family child care home without a state license, is a violation. The city may not, however, impose zoning permits or business license requirements barred by state law.
