Full Breakdown

Sec. 37-167 of Champaign's zoning code makes a home occupation "a permitted accessory use in each district in which a residential dwelling unit is permitted," subject to a list of limitations. " No employees who do not reside at the residence may work on-site, and the structure's appearance cannot be altered so that the premises differ from its residential character. Storage of merchandise for off-premises sales is allowed, but no goods, equipment, or storage connected with the occupation may be kept outdoors, and nothing may be visible or displayed from outside the building.

The operation must also stay within all applicable building, fire, health, safety, and housing codes and comply with business and occupational licensing requirements, and it may generate no noise, vibration, glare, smoke, dust, electromagnetic interference, or odor detectable beyond the property line, including through party walls. If more than one home occupation operates from a single dwelling, the combined impact of all of them together still cannot exceed these standards. Retail sales to walk-in customers are allowed only if clearly incidental to the underlying home occupation, not as its primary function.

Violations & Fines

A home occupation exceeding the 25% floor-area cap, employing outside workers, or altering the home's residential appearance violates Sec. 37-167 and is a zoning code violation; the city's Building Safety Division/Planning Division can issue a notice of violation and pursue compliance action, including revocation of the associated business license, until the use is brought into conformance.

Frequently Asked Questions

How much of my house can I use for a home business in Champaign?
No more than 25% of the home's gross floor area, per Sec. 37-167(d). The business must also be conducted entirely inside the principal building or an accessory structure, not outdoors.
Can I hire employees for a home-based business?
No. Sec. 37-167(a) states there shall be no on-site employment or employment of persons not residing at the residence, so only household residents can work on the business.
Can I sell products to walk-in customers from my home?
Only if it's clearly incidental to the home occupation itself, per Sec. 37-167(q); the section is written to keep retail from becoming the business's primary activity.
