Fort Waynes Unified Development Ordinance authorizes home occupations in residential districts as an accessory use. Indiana enabling statute IC 36-7-5 grants the city zoning authority. Standard UDO limits: the business must be conducted by a resident, occupy only a small portion of the dwelling (commonly 25 percent of floor area or less), generate no external evidence other than a small sign, produce no noise, odor, dust, vibration, or traffic beyond normal residential patterns, and employ no more than one non-resident worker (or zero in some districts). Certain uses are expressly prohibited as home occupations: auto repair, welding, cabinet shops, kennels, funeral services, medical or dental clinics, and retail storefronts. Conditional-use approval from the Board of Zoning Appeals is required for home occupations that exceed standard limits. Non-compliant operations can trigger zoning violation notices with daily fines.
Zoning violation notices include an order to cease operation and can accumulate daily fines until compliance or BZA approval.
