Kirkland Zoning Code Chapter 115.35 allows home occupations as an accessory use in all residential zones. A home occupation must be clearly incidental and secondary to the dwelling's primary residential use. The business must be conducted entirely within the dwelling or an approved accessory structure, may not occupy more than a limited percentage of the floor area (typically 25 percent), and may employ no more than one nonresident employee on site. Exterior evidence of the business such as stock on display, outdoor storage, or excessive parking is prohibited. Deliveries must be limited to those typical of a residence. Prohibited home occupations include vehicle repair, medical offices with patient visits beyond limits, large-scale manufacturing, and uses generating offensive noise, vibration, smoke, dust, odor, or electrical interference. A Kirkland business license is required under KMC Title 7. More intensive uses may require a Process I or II Conditional Use Permit. Kirkland's updated rules also reflect state preemption under RCW 35A.21.300 protecting daycare as a home occupation.
