Lubbock permits home occupations in residential zones subject to Code Chapter 40 limits: the home must remain primarily a residence, activity must be inside the main dwelling, and the business must not generate nuisances.
Under Lubbock Zoning Ordinance Chapter 40, a home occupation is a secondary use of a dwelling for lawful business by the resident, subject to standards: the use must be clearly incidental to residential use; conducted entirely inside the principal dwelling (not in a detached garage or shed in many cases); no more than a limited portion of the floor area (often 25 percent); no non-resident employees on site; no storage of hazardous or flammable materials beyond normal household amounts; no outdoor display, storage, or equipment visible from the street; no alteration of the residential appearance of the home. Some occupations are prohibited outright: vehicle repair, commercial kennels, welding shops, and similar uses that produce noise, odor, or traffic. Home occupations typically do not require a city permit but must register for sales tax if applicable and may need a home occupation permit in some zoning overlays. Texas has no statewide home business preemption.
Zoning violation: notice of violation, up to 2,000 dollar fine per day until compliant, possible cease-and-desist order.
