In unincorporated Orange County, home-based businesses are governed by Section 7-9-104 (Home occupations) of the County Comprehensive Zoning Code, administered by OC Planning / OC Development Services. Home occupations are permitted as an accessory use to a residential use only in districts that list home occupations as a permitted use, and they must comply with the general requirements in subsection (c). Those requirements include: a cottage food operation must comply with all applicable State regulations and may not sell any prepared foods on-site; there shall be no exterior evidence of the conduct of a home occupation; the home occupation must be conducted only within the enclosed living area of the dwelling unit; it must not generate offensive or objectionable noise, dust, vibration, smell, smoke, heat, glare, or radiation, and electrical or mechanical equipment that creates radio/TV interference or line-voltage fluctuations outside the dwelling is prohibited; there may be no more than one client on the premises at any given time; the principal character or use of the dwelling unit must not change; there shall be no signs; required residential off-street parking must be maintained; the use must not create greater vehicular or pedestrian traffic than is normal for the district; and the distribution, transporting, manufacturing, cultivating, or delivery of cannabis or cannabis products from the home is not permitted as a home occupation. These standards are meant to keep home businesses compatible with the residential neighborhood.
Operating a home business that produces exterior evidence, posts a sign, draws more than one client at a time, generates excess traffic, creates noise/odor/interference, or changes the residential character of the dwelling violates Section 7-9-104 and is subject to County code enforcement.
