Under Newark Title XLI Zoning and Land Use Regulations, a home occupation is a lawful activity conducted entirely within the principal dwelling unit or an accessory structure, clearly incidental and secondary to the residential use of the property. Only one home occupation is allowed per dwelling unit. The operator must be the property owner or a tenant with notarized owner consent. Permitted activities include professional offices, personal instruction, personal care services, art production, artisan manufacturing, online commerce, sewing and tailoring, and food production subject to health regulations. The area devoted to the home occupation cannot exceed 20 percent of the gross floor area of the dwelling. A maximum of one employee who does not reside at the property may work on-site. There must be no change in the exterior appearance of the dwelling, no visible evidence of the business including artificial lighting, and no signage. Vehicles associated with the business must park in a driveway or garage. Deliveries are limited to standard parcel services such as USPS, UPS, or FedEx. Plans must be submitted to the Administrative Officer for review.
