Full Breakdown

Placentia Municipal Code § 23.81.020 allows incidental and limited nonresidential activities within dwelling units. Subsection (a) says a home occupation shall be secondary to the dwelling unit's primary function as a residence and compatible with the neighborhood.

The operating standards in subsection (b) run from (1) through (15). There shall be no employees other than the residents of the dwelling unit. Only one (1) room of the home or accessory structure shall be used, and a new access from that room exiting directly to the street is prohibited. The garage cannot be altered or used in a way that reduces the covered off-street parking spaces required by the zoning district. Limited indoor storage of stock or merchandise is permitted in the designated space, but outside use or storage of materials, bulk goods, merchandise, equipment, special purpose machinery or vehicles customarily used in a commercial or industrial business is not permitted.

The appearance of the structure or premises cannot be altered to change its residential character or visually signal that a business operates in the dwelling. No equipment, activity or process can generate excessive sound or noises, glare, vibrations, odors or fumes, or cause interference to radio or television reception. The business cannot generate additional vehicular or foot traffic beyond normal residential uses, and no direct sales, display or commercial signage is permitted on the premises. One (1) business related vehicle, which includes either a pickup or van, is permitted, and § 23.78.170(a) supplies the definition of commercial vehicles. Storage of explosives, highly combustible materials or hazardous material is strictly prohibited. For rental property, the owner's written authorization must be submitted with the application.

Under subsection (c), the application is submitted to and approved by the planning division prior to issuance of a city business license. Subsection (d) makes a violation a misdemeanor and grounds for revocation after review by the director of development services, and all decisions of that director can be appealed to the planning commission.

Violations & Fines

A violation of § 23.81.020 is a misdemeanor and also grounds for revocation of the home occupation permit after review by the director of development services. Under § 1.08.010 the City of Placentia punishes a misdemeanor with a fine not exceeding $1,000 or imprisonment not exceeding one year, or both, and each day a violation continues is a separate offense. The director's decisions can be appealed to the planning commission.

Frequently Asked Questions

Do I need a permit to run a business from my home in Placentia?
Yes. Under § 23.81.020(c), an application for a home occupation permit must be submitted to and approved by the planning division before the City of Placentia issues a city business license. Rental tenants must also attach the property owner's written authorization to the application.
Can I hire employees or have customers visit?
Employees are out: there shall be no employees other than the residents of the dwelling unit. The standards also bar additional vehicular or foot traffic beyond normal residential uses, and no direct sales, display or commercial signage is permitted on the premises, so customer visits are not allowed.
How much of my house can the business use?
Only one (1) room of the home or accessory structure can be used, and building a new access from that room that exits directly to the street is prohibited. The garage cannot be altered or used so as to reduce the covered off-street parking spaces the zoning district requires.
What happens if I break the home occupation rules?
A violation is a misdemeanor and can also be grounds for revocation of the permit after review by the director of development services. The director's decisions can be appealed to the planning commission. The general misdemeanor penalty in § 1.08.010 is a fine up to $1,000 or up to one year in jail.
