Home occupations in unincorporated Palm Beach County are allowed by right under PBC ULDC Article 4.B.1.A.6 in residential districts subject to performance standards limiting visibility, traffic, and external impact. Cottage food operations are protected under FL FS §500.80.
PBC ULDC Article 4 permits a home occupation as an accessory use in any residential district provided: (1) operated only by residents of the dwelling, with no more than one non-resident employee on site; (2) occupies no more than 25 percent of the dwelling's gross floor area; (3) no exterior alteration that changes residential character; (4) no outdoor storage of materials, equipment, or vehicles; (5) no commercial vehicles over 14,000 lbs GVWR parked on site; (6) no manufacturing, retail sales except by appointment, or assembly of products. A PBC Business Tax Receipt (BTR) is required from the Tax Collector for most operations. Cottage food operations under FL §500.80 are exempt from BTR for the food activity itself. Home daycare licensed by DCF is permitted under separate state preemption FS §402.302.
Operating outside performance standards: ULDC violation, Special Magistrate fines to 250 dollars per day. Operating without a BTR: PBC Tax Collector enforcement, back taxes plus penalties.
