Summary

Tazewell County lets residents run a home occupation by right in any residential or agriculture zoning district, but only inside the dwelling itself and only if it meets eleven conditions listed in Zoning Code Section 157.052. Operators must pull a $200 zoning permit before opening, and a business that outgrows these limits becomes a regulated Home Commercial use instead.

These county ordinances apply to unincorporated areas of Tazewell County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Any home occupation which is customarily, in whole or in part, conducted in a residential or agriculture district shall be permitted in such district, provided that all of the following criteria are met: (A) A home occupation shall not be conducted from an accessory building; ... (E) Activities of the home occupation on the premises must be conducted entirely within the dwelling and only by members of the family residing on the premises; (F) There shall be no exterior storage of materials or equipment; (G) The home occupation shall not utilize mechanical, electrical, or other equipment which produces noise, electrical or magnetic interference, vibration, heat, glare, or other nuisances outside the dwelling; (H) The home occupation shall not include the conducting of retail sales on the premises, other than by mail, phone, or internet; (I) The home occupation shall not be open to the public between the hours of 8:00 p.m. and 9:00 a.m.

Full Breakdown

052 permits a home occupation in any residential or agriculture district only if it satisfies all eleven listed conditions. The business cannot run out of a garage, barn, or other accessory building (A); it must show no exterior sign of its existence beyond one sign that cannot be illuminated, cannot cross the lot line, and cannot exceed two square feet (B, C); it cannot receive deliveries by anything larger than a passenger vehicle or standard parcel carrier (D); and all activity must happen inside the dwelling and be performed only by family members who live there (E).

m. (I). 052(K) lists examples of permissible occupations, such as art studios, one-chair barber shops, professional offices, seamstress work, single-pupil music or dance instruction, and repair of watches, clocks, computers, and small household appliances, though the list is non-exclusive. 600(B)(1). A use that exceeds any of these limitations is redefined under the code's definitions section as a HOME COMMERCIAL use, which can only proceed with special-use approval from the Zoning Board of Appeals rather than as a by-right home occupation.

Violations & Fines

Operating outside these limits, running a business from an outbuilding, hiring outside employees, storing equipment outdoors, or staying open past 8 p.m., is a petty offense under the chapter's general penalty at Section 157.999(B): a fine of up to $500 per offense, with each week the violation continues counted as a separate offense. The Community Development Administrator issues a notice of violation and can call the operator before the County Adjudication Hearing Officer.

Frequently Asked Questions

Can I run my home business out of my garage or a shed in unincorporated Tazewell County?
No. Section 157.052(A) requires the home occupation to be conducted from within the dwelling itself; using an accessory building such as a garage, barn, or shed for the business disqualifies it from home-occupation status entirely.
How much does a Tazewell County home occupation zoning permit cost?
The zoning permit fee for a home occupation is $200, charged under Section 157.600(B)(1) and collected by the Community Development Administrator before the business may operate.
Can my home-based business hire employees who don't live at the house?
No. Section 157.052(E) limits all on-site activity to members of the family residing on the premises, so bringing in outside staff to work at the home takes the business outside the permitted home-occupation standards.
What happens if my home business grows past what Section 157.052 allows?
It is reclassified as a HOME COMMERCIAL use under the code's definitions, meaning it exceeds one or more Section 157.052 limits, and it can no longer operate by right; it needs special-use approval from the Zoning Board of Appeals first.
