Bonita Springs, FL Homelessness & Encampment Rules: Encampment Sanitation (2026)

The Bonita Springs City Council regulates park conduct in Chapter 28. Sec. 28-37(a) prohibits sleeping overnight in any area of a city park except for authorized campers in designated camping areas. Sec. 28-37(n) separately bars sleeping on park benches, picnic tables or other structures not designated for that use, and bars congregating near a public restroom or a vehicle parking area so as to interfere with its use by others. Sec. 28-37(f) bars entering an area posted "Closed to the public." Sec. 28-32(e) bars setting up tents, shacks or any other temporary shelter for overnight camping outside designated camping areas, and bars leaving a movable structure or vehicle in a park after closing hours that could be used for that purpose, except by special written permit from the director.

Sec. 28-44 keeps parks open every day with posted hours and lets the director close any section of a park temporarily or at regular intervals to protect the environment or public health, welfare and safety. Sanitation rules back this up: Sec. 28-43(b) bars leaving bottles, boxes, cans, rubbish, waste, garbage or trash anywhere in a park, and Sec. 28-32(d) bars leaving personal effects, chairs and cooking instruments at a park site when not in use. Sec. 28-40(a) prohibits motor vehicles on all beaches and lets the city tow vehicles left in the same area more than 48 hours.

On public beaches, Sec. 46-99(b) makes it unlawful to sleep between 10:00 p.m. and 6:00 a.m. of the following day, and Sec. 46-98 lets all duly authorized law enforcement agencies within the county enforce that division.
