Summary
In unincorporated Bonner County, Idaho, Bonner Park West bans overnight camping in any form, from tents to RVs and boats. A violation is a misdemeanor with a fine up to $300, up to six months in county jail, or both. The Board of County Commissioners adopted the rule in Ordinance 414.
B. There shall be no overnight camping anywhere within the park, including, but not limited to, recreational vehicles, motor vehicles, boats, or any other type of facility, contrivance, tent, camper, trailer or other vehicle. ... Any violation of this chapter and the regulations herein is declared to be a misdemeanor and punishable by a fine of not more than three hundred dollars ($300.00) or by imprisonment in the county jail not to exceed six (6) months, or by both such fine and imprisonment.
Full Breakdown
The rule lives in Title 5, Chapter 2 of the Bonner County Revised Code and covers one parcel only: the land described in Ordinance 414, effective September 1, 2001, and commonly known as Bonner Park West. Section 5-202(B) says there shall be no overnight camping anywhere within the park, and it lists recreational vehicles, motor vehicles, boats, tents, campers, trailers and any other facility, contrivance or vehicle. A person sleeping in a parked car is covered just as a person in a tent is.
The same section also closes the park from sunset to sunrise and bars anyone from the park during those hours, so a camper faces two separate rules. Boats and water vehicles cannot be docked or parked overnight at the beach or launch area, although a boat on a trailer can stay overnight in the parking lot.
The county's other campground area, the Garfield Bay Recreation Area, has its own chapter. Section 5-320 defines camping as any overnight stay in a recreational vehicle, motor vehicle, boat, trailer, tent, camper or other vehicle, and section 5-330(B)(5) bars overnight camping in the day use area. Paid camping there requires a registration envelope and fees, with a maximum stay of ten consecutive days in one spot under section 5-380.
Chapters 2 and 3 of Title 5 print no cleanup protocol, notice period or property storage procedure for camps. Those chapters regulate use of two county recreation sites, not camping on other county land, and the Revised Code sections read for this page do not address camping on city streets in Sandpoint, Ponderay or Priest River, which are separate cities.
Violations & Fines
Under section 5-210, any violation of the Bonner Park West chapter is a misdemeanor punishable by a fine of not more than $300, by imprisonment in the county jail not to exceed six months, or by both. At Garfield Bay, section 5-390 makes a violation an infraction with a penalty authorized by Idaho Code section 31-714, as limited by Idaho Code section 18-113A, not to exceed $300.
