Full Breakdown
City of Oneida Code § 151-20, added November 15, 2022, by Local Law No. 9-2022 as Chapter 151, Article VII, Obstructions in Public Places, prohibits camping and the erection of tents or other structures on public property unless authorized by a permit from the Director of Parks and Recreation. The same section separately bars placing tarps, sleeping bags, or other coverings, and storing or placing personal property on the ground, benches, sitting areas, or walkways, wherever that placement unreasonably interferes with others' use of the public property.
Section 151-21 sets the permit process: a written application goes to the Director of Parks and Recreation on department forms, disclosing the applicant's name, address, and phone number, the dates of the planned camping or tent erection, the number of people, animals, and vehicles that will be present, the location, and any further information the Director finds reasonably necessary to decide the application. A fee set by the Common Council is due when the application is filed. Section 151-22 carves out one narrow exception: funeral tents of up to 700 square feet used at cemeteries need no permit at all.
The article gives the city a defined enforcement tool for encampments and stored belongings on parks, sidewalks, and other public grounds without relying on the general obstruction provisions in Article III.
Violations & Fines
City of Oneida Code § 151-23 makes any violation of Article VII punishable by up to 15 days' imprisonment or a fine of up to $250, or both. Each day the violation continues counts as a separate, additional offense, so an uncleared encampment or unpermitted tent can accumulate a new violation daily.
