Ashwaubenon, WI Homelessness & Encampment Rules: Sit-Lie Rules (2026)

Section 9-1-5, titled Obstructing Streets and Sidewalks Prohibited, makes it unlawful to stand, sit, loaf, loiter or engage in any sport or exercise on a public street, sidewalk, bridge or public ground in a manner that prevents or obstructs free passage of pedestrian or vehicular traffic, or that prevents or hinders free ingress to or egress from any place of business or amusement, or any church, public hall or meeting place. The provision is drawn narrowly around obstruction: it does not ban sitting or standing on a sidewalk outright, only doing so in a way that blocks the path of others or blocks access to a doorway.

05 of the 2006 Code, so it has stood as the Village's core sidewalk-clearance rule for years and was still current as of the June 24, 2026 code update. Because the section does not carry its own penalty clause, an officer citing it relies on the Municipal Code's general enforcement and penalty provisions in Chapter 1, and the Village's citation method of enforcement under Section 1-1-14, which lets officers issue a municipal citation identifying the alleged violator, the facts, the time and place, and the Code section violated rather than making an arrest.
