Summary

During a declared disaster, the Alachua County Board of County Commissioners can order collection of hazardous debris from public and private land, enter private property with owner consent, and suspend parts of the County Code to speed cleanup, under Alachua County Code § 27.09.

These county ordinances apply to unincorporated areas of Alachua County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(2)The Board shall...have the power and authority to:(a)Determine that a threat to public health and safety may result from the generation of widespread debris throughout the County, using any of the following criteria:...5.That it is in the public interest to collect and remove disaster debris from property whether public or private lands, or public or private roads to eliminate any immediate threat to life, public health and safety;...(b)With the consent of the property owner, authorize the county or its contracted agents the right of access to private property and roads or gated communities as needed by emergency vehicles such as, but not limited to, police, fire, medical care, debris removal, and sanitation to alleviate immediate threats to public health and safety and to provide emergency repairs to vital infrastructure assets.(c)With the consent of the property owner, authorize the removal of debris and wreckage resulting from a major disaster from property whether public or private lands, public or private roads, or within gated communities for safe and sanitary living or functioning conditions.

09(2) gives the Board of County Commissioners standing authority, layered on top of whatever powers a declared state of emergency triggers under Article 27, to act on storm debris once it determines the debris is a threat to public health and safety. The Board may make that finding using any of seven listed criteria: debris blocking movement and transportation for residents and emergency/relief services, debris endangering properties, conditions that breed disease and vermin, increased fire risk, the public interest in removing disaster debris from public or private land or roads to eliminate an immediate threat to life or safety, reducing the risk of additional property damage, and promoting the community's economic recovery.

09(2)(b) lets the county or its contracted agents enter private property, private roads, or gated communities, but only with the property owner's consent, for emergency vehicles including police, fire, medical care, debris removal, and sanitation crews. 09(2)(c) separately authorizes removal of debris and wreckage left by a major disaster from public or private land, public or private roads, or inside gated communities, again with owner consent, to restore safe and sanitary conditions. The same section lets the Board authorize removal of derelict vessels from public waters in coordination with the Florida Fish and Wildlife Conservation Commission, and abandoned vehicles in coordination with law enforcement, and lets the Board temporarily suspend enforcement of the County Code where the emergency requires action outside the Code.

The provision was adopted by Ord. No. 2016-12 (Aug. 9, 2016) and amended by Ord. No. 2022-03 (Jan. 25, 2022). It applies countywide but governs unincorporated Alachua County operations; Gainesville and the county's other eight municipalities run their own post-storm debris programs.

Violations & Fines

Section 27.09 is a grant of emergency authority to the Board and County Manager rather than a citation scheme against residents, so it does not set fines for individual property owners. Access to private property for debris removal requires the owner's consent under § 27.09(2)(b)-(c); the county cannot force entry onto private land under this section without it. Separate County Code sections govern illegal dumping and unpermitted disposal of construction and demolition debris outside a disaster declaration.
