Summary

Anything built seaward of Florida's coastal construction control line in unincorporated Escambia County, from Perdido Key to Pensacola Beach, must meet the stricter of two Florida Building Code sections plus ASCE 24's flood-resistant design standard. LDC section 4-2.11 layers these hurricane-specific rules on top of the county's ordinary floodplain requirements, and even storage-only accessory structures face size caps and anchoring rules by flood zone.

These county ordinances apply to unincorporated areas of Escambia County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(b)Buildings and structures seaward of the coastal construction control line. If extending, in whole or in part, seaward of the coastal construction control line and also located, in whole or in part, in a flood hazard area:(1)Buildings and structures shall be designed and constructed to comply with the more restrictive applicable requirements of the Florida Building Code, Building Section 3109 and Section 1612 or Florida Building Code, Residential Section R322.(2)Minor structures and non-habitable major structures as defined in Section 161.54 Fla. Stat., as amended, shall be designed and constructed to comply with the intent and applicable provisions of this article and ASCE 24.

Full Breakdown

Escambia County layers hurricane-specific construction standards on top of its base floodplain rules for anything seaward of the state's coastal construction control line. 11(b) requires buildings and structures that extend, in whole or in part, seaward of the coastal construction control line and also sit in a flood hazard area to meet the more restrictive of the Florida Building Code's Building Section 3109 and Section 1612, or the Residential Code's Section R322. 54, Florida Statutes, must still comply with this article and with ASCE 24, the national flood-resistant design standard.

11(a) separately requires any building exempt from the Florida Building Code, including substantial improvements or repairs of substantial damage, to be designed and built to ASCE 24's flood load and flood-resistant construction requirements. 11(c) allows non-elevated accessory structures below the required elevation only if used solely for parking or storage, one story and no larger than 600 square feet with flood openings in Zone A/AE areas outside coastal high-hazard zones, or no larger than 100 square feet and not below an elevated building in coastal high-hazard Zone VE, anchored against flotation in both cases and built with flood damage-resistant materials below the base flood elevation.

Violations & Fines

The same enforcement chain governing LDC Article 4-2 applies here: building without a required permit, exceeding it, or failing to fully comply is a violation under section 4-2.9(a), and a structure without documented elevation or design certification is presumed noncompliant until the owner supplies it. The floodplain administrator issues notices of violation or stop-work orders, and continuing work after one draws penalties as prescribed by law. Variance requests go to the Board of Adjustments, which cannot grant one in a floodway if it would raise base flood elevations.

Frequently Asked Questions

What construction standard applies seaward of the coastal construction control line?
Section 4-2.11(b) requires buildings there that also sit in a flood hazard area to meet the more restrictive of Florida Building Code Building Section 3109 and Section 1612, or Residential Section R322, whichever demands more from the design.
Can I build a storage shed below the flood elevation on Perdido Key or Pensacola Beach?
Only if it is used solely for parking or storage. In Zone A/AE outside coastal high-hazard areas it must be one story, no larger than 600 square feet, with flood openings; in coastal high-hazard Zone VE it cannot exceed 100 square feet or sit below an elevated building, per section 4-2.11(c).
What if my property is a minor structure like a gazebo, not a house?
Minor structures and non-habitable major structures, as defined at section 161.54, Florida Statutes, still must comply with LDC Article 4-2 and with ASCE 24's flood load and flood-resistant construction requirements under section 4-2.11(b)(2).
