Effective upon the date that this provision shall become law, the planting or growing of bamboo shall be prohibited within the Town of Babylon unless: A. The root system of such bamboo plant is entirely contained within an above-ground-level planter, barrier or other vessel... C. ...all bamboo plants shall be located, trimmed and maintained so that no part of the plant (including stalks, branches, leaves, and/or roots) shall extend nearer than 10 feet to any property line.

Town of Babylon Code § 145-3 prohibits planting or growing bamboo anywhere in the Town unless the root system is entirely confined to an above-ground planter or vessel, or to a below-ground barrier meeting the chapter's specs: 40-mil polypropylene or polyethylene, installed at least 30 inches deep, protruding 3 inches above grade, sloped outward. Even contained bamboo must be trimmed so no stalk, branch, leaf, or root comes within 10 feet of a property line. Section 145-6 bars replanting once existing bamboo dies or is removed, and an owner is liable for the Town's cost of removing bamboo that spreads onto Town property.

Each day of unlawful bamboo planting or growth is a separate offense, fined $100 to $500 per violation under § 145-7; an owner is also billed for the Town's cost of removing bamboo that spreads onto Town land.
