These county ordinances apply to unincorporated areas of Gwinnett County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

On each property for which a Tree Preservation and/or Replacement Plan is required, existing trees shall be retained and new trees shall be planted such that the property shall attain or exceed a Tree Density Standard of 16 Tree Density Units per acre, or 20 Tree Density Units per acre as specified in the Overlay Districts, or 24 Tree Density Units per acre for limited land-disturbing activities (Sections 630-10.4, 5, 6 and 7).B.Trees, both existing and new, shall be reasonably distributed throughout the site, with emphasis on tree groupings to achieve aesthetic results following professional landscaping standards. Trees, including street trees, may be retained, or planted for credit within a public street right-of-way.C.Trees located in a stream buffer may be counted toward fulfilling the Tree Density Standard provided the acreage within the stream buffer is included in the calculations used to fulfill the Tree Density Standard.D.Trees, both existing and new, located in a temporary construction buffer may be counted toward fulfilling the Tree Density Standard provided the acreage within the temporary construction buffer is included in the calculations used to fulfill the Tree Density Standard.E.If a specimen tree's Critical Root Zone (CRZ) falls outside of the buffer partial credit may be obtained toward fulfilling the Tree Density Standard. See Section 630-30.5 in this UDO.

Full Breakdown

Wherever a Tree Preservation and/or Replacement Plan is required, Gwinnett County's UDO sets a baseline Tree Density Standard of 16 units per acre, rising to 20 in Overlay Districts and 24 for limited land-disturbing activities like diseased-tree removal or timber harvesting. Credit toward the standard comes from preserved existing trees (scaled to trunk diameter), newly planted replacement trees (scaled to caliper), and preserved specimen trees, which earn bonus credit. Developers who cannot meet the standard on-site may use the Tree Bank monetary-compensation option, but only after documenting hardship to the Director; trees required for buffers or landscape strips can't use that option.

Violations & Fines

A site that can't document compliance with its Tree Density Standard on the required plan won't get plan approval; using the Tree Bank without documented hardship is not permitted.

Frequently Asked Questions

Can a developer just pay a fee instead of planting replacement trees?
Only with documented hardship approved by the Director: the Tree Bank option under UDO § 630-80 can't be used for required buffer, landscape strip, or frontage plantings.
Do preserved existing trees count toward the requirement?
Yes: existing trees earn density-unit credit scaled to trunk diameter under UDO § 630-30.1 and Table 630.2.
