The Tree Ordinance (Chapter 8.14, Article IV) makes owners responsible for pruning private trees so they do not obstruct pedestrians, vehicles, sight lines, or traffic-control devices. Abutting owners also maintain the public trees in the right-of-way, but only a licensed contractor with prior City Arborist authorization may remove, cut, or trim them. Derechos, ice storms, and the emerald ash borer have driven heavy pruning across Davenport's 22,000-plus public trees. Overhanging branches from a neighbor's tree may be trimmed back to your property line.
Municipal infraction under 8.14.360: $100 first offense, $200 second, $500 subsequent, each day separate. If an owner fails to prune, the City Arborist orders the work done and assesses the cost against the property.
