There is no countywide Essex County weed ordinance for private property. New Jersey authorizes municipalities under N.J.S.A. 40:48-2, including subsection 40:48-2.13, to declare tall grass, weeds, brush, and debris a nuisance and to order owners to remove them. Each Essex County municipality, including Newark, adopts and enforces its own property-maintenance and weed provisions through its code or property-maintenance official, with its own definitions, notice periods, and penalties. The county's role is limited to maintaining county-owned parcels, county park land, and county road rights of way.
