A Texas county cannot pass a general weed ordinance like a municipality. Instead, Chapter 343 makes weeds within 300 feet of a neighboring residence or business a public nuisance in the unincorporated area. The county must serve written notice describing the condition and give the owner a deadline (generally 31 days, or 10 business days for repeat offenders) to clean up. If the owner fails, the county may abate the nuisance itself, assess the cost against the responsible person, and place a lien on the property. Incorporated cities enforce their own separate weed and lot codes.
Fine $50-$200 (repeat $200-$1,000 or up to six months jail); each day is a separate offense; county abatement costs become a property lien.
