Under BMC 4-2-207, 'weeds' is defined broadly to include weeds bearing downy/wingy seeds; sagebrush, chaparral, and brush that becomes a dry fire menace to adjacent property; noxious or dangerous weeds, poison oak and poison ivy that menace public health; 'dry grass, stubble, brush, or other flammable material which endangers the public safety by creating a fire hazard'; and vegetation, vines, and shrubs overgrowing curblines or draping over walls/fences into public streets - all declared public nuisances. BMC 4-2-208 states that 'the owner or person in control of any private property shall at all times maintain the premises free of weeds.' Enforcement under BMC 4-2-209 lets the Public Works Director notify the owner by certified mail (with a posted copy) and gives the owner 5 days to dispose of the weeds; if uncorrected, the city abates them and the cost becomes a lien on the property.
After a 5-day certified-mail notice, the city may dispose of the weeds and assess the cost as a lien on the property (BMC 4-2-209). Burbank may also use the State weed-abatement contract procedure under BMC 4-2-201 to 4-2-206.
