Cheektowaga, NY Landscaping Rules: Weed Ordinances (2026)

Chapter 66, adopted October 1, 2001 and amended in its entirety November 21, 2005, requires under Section 66-1 that every owner of any area, lot or parcel cut, trim or remove all grass, weeds, brush or plant growth in excess of six inches. The chapter's definition of "brush," "weeds," "obnoxious growth" and "debris" sweeps in grasses, annual plants and vegetation other than trees or shrubs, dead or dying trees, stumps, roots, filth, garbage and trash, while expressly excluding cultivated flowers and gardens. Section 66-2 extends the duty to curbs, gutters and sidewalks bordering a parcel, which must stay clear of the same growth.

Enforcement starts with the Supervising Building and Plumbing Inspector, who under Section 66-3 gives written notice to a noncompliant owner with five days to cut, destroy and remove the growth; a second notice on the same property within the same calendar year shortens that window to just two days. Notice can be served by certified mail, personal delivery, posting at the residence with follow-up mailing, or, if none of those work, two weeks of publication in the official Town newspaper plus posting on the property, per Section 66-3C.

If the owner still does not comply, Section 66-5 lets the Town cut or remove the growth itself and assess the cost to the property, and Section 66-6 adds a flat $200 administrative fee on top of the actual cost, both becoming a lien on the property, drawing interest at the real estate tax rate, if unpaid within 30 days of billing.
