Under Winston-Salem Code Chapter 46, weeds and non-ornamental vegetation over 12 inches are declared a public nuisance on developed property. The city can order abatement and, after notice, cut the lot and lien the owner for costs.
The weed ordinance runs parallel to the grass-height rule. Weeds, including ragweed, kudzu, poison ivy on fence lines, and invasive species, are treated as nuisances when they exceed 12 inches or when they create a health or fire hazard. Inspectors respond to CityLink 311 complaints. Vacant and undeveloped lots are held to the same standard within 300 feet of any structure. Owners receive a written notice with a cure period (commonly 10 days). If not abated, the city contracts a cut and charges the owner. Costs and administrative fees become a lien if unpaid. Beekeepers and native-plant gardens may qualify for exemption with documentation. Noxious weeds on the NC Department of Agriculture list (e.g., Cogongrass, Giant Hogweed) may require specific control and reporting.
Failure to abate: city mow + admin fee, lien if unpaid. Repeat offenses: civil penalty under Chapter 46 up to $500 per day.
