San Marcos, CA Mobility & Curb Rules: Bike Lane Rules (2026)

Section 12.20.030 lists ten places where stopping, standing, or parking any vehicle is unlawful, and subsection (h) puts bike lanes on that list alongside parkways and sidewalks: 'Within any parkway, upon any sidewalk, or within a designated bike lane.' The ban applies whenever a lane is marked, not just during posted hours, and covers any vehicle left there, not only unattended cars. On the cyclist's side of the street, Chapter 12.25 treats a bicycle as a vehicle for the rules of the road. Section 12.25.030(a) grants 'every operator or passenger riding a bicycle upon a roadway... all of the rights and... all of the duties applicable to the operator or passenger of a vehicle,' and subsection (b) requires a rider to 'obey the instructions of official traffic control signals, signs, and other control devices applicable to vehicles.' Riding on a sidewalk is separately restricted under § 12.25.040: it is unlawful in a business district or on any street with a designated bicycle path, though sidewalk riding is allowed in exclusively residential areas unless the sidewalk itself is posted against it, and a cyclist on a sidewalk must yield to pedestrians.

Violations of either chapter are enforced by the San Marcos Police Department, and § 12.25.060 lets the issuing agency divert a first-time bicycle-rule violator into a safety program instead of court, when one is available.
