Adopted by Ordinance No. 2703 in March 2019 and amended by Ordinance No. 2709 two months later, § 62-101 defines an electric bicycle as a bicycle or tricycle with fully operable pedals and a motor under 750 watts that meets one of three classes. A Class 1 electric bicycle assists only while the rider pedals and stops assisting at 20 mph. A Class 2 electric bicycle can be propelled by the motor alone and is not capable of assisting past 20 mph. A Class 3 electric bicycle assists only while pedaling and stops assisting at 28 mph.
Section 62-103 then sets where each class may operate: all micromobility devices, including e-bikes, may be used on streets posted at 25 mph or less, and on multi-use paths and sidewalks unless prohibited by signage, except that Class 3 electric bicycles are specifically barred from both multi-use paths and sidewalks because of their higher assist speed. E-bikes are also barred from streets posted above 25 mph and from any area where signage prohibits micromobility use, though electric bicycles, unlike other micromobility devices, are permitted in designated bicycle lanes.
Riders must yield to pedestrians, obey traffic-control devices, and dismount and walk the device across any prohibited area; a nighttime e-bike must carry a front white lamp visible 500 feet and a rear red reflector visible 50 to 300 feet.
Violations & Fines
The town may issue a civil citation for violating § 62-103's operating rules, including riding a Class 3 e-bike on a sidewalk or multi-use path, under Section 1-5 of the Code. Chapter 62 classifies these as civil traffic violations subject to A.R.S. Title 28, Chapter 5, Articles 3 and 4.
