Section 299-30 of the Borough Code, part of Chapter 299, Vehicles and Traffic, bars operation of any gas or electric scooter that is not legally registered as a motor vehicle with the State of New Jersey. The prohibition reaches every municipal roadway, sidewalk, and recreation area within Bergenfield's borders and applies whether or not the operator holds a driver's license. The Borough Council carved out a single exception: private property, and only when the owner has given express permission to operate there. Any other public right-of-way, including sidewalks used for pedestrian travel and recreational areas such as parks and fields, is off-limits to unregistered scooters.

A. 39:4-203, New Jersey's general penalty provision for Title 39 traffic offenses, applied by the Bergenfield Police Department through municipal court. Because the ban turns on registration status rather than scooter type, a scooter titled and registered with the New Jersey Motor Vehicle Commission as a motor vehicle would fall outside the prohibition, though ordinary kick-style or throttle scooters sold for personal use are not eligible for that registration and stay barred from public ways. Residents who want to ride recreationally are effectively confined to their own property or a property whose owner has agreed to allow it; the traffic chapter carves out no borough permit, share-program authorization, or striped no-ride zone for shared scooter operators.
