Sec. 34-366(11) exempts "sound produced between the hours of 7:00 a.m. and 9:00 p.m. from the emptying of trash dumpsters or by the delivery, pickup, or raising of any dumpster, in or near residential areas" from prosecution under the noise article. Unlike the lawn-equipment exception in Sec. 34-366(6), this one sets no decibel ceiling at all, only a time window, reflecting that dumpster service inherently involves loud metal-on-metal noise that the city chooses to tolerate strictly during daytime and evening hours. If a waste hauler or delivery driver empties, delivers, picks up or raises a dumpster near residential property before 7 a.m. or after 9 p.m., the exception does not apply and the activity falls back under the general noise prohibition in Sec. 34-362 and the numeric ceilings in Sec. 34-363 (75 dB(A) between 7 a.m. and 9 p.m., 65 dB(A) at all other times), both enforceable on complaint or officer observation by Baytown Police.
